Welcome to LeaveBye. These Terms of Use (“Terms”) are an agreement between you and LeaveBye (“LeaveBye,” “we,” or “us”). By opening or using leavebye.com or the LeaveBye app (the “Service”), you agree to these Terms. If you do not agree, please do not use the Service.
1. What LeaveBye does
LeaveBye estimates a time to leave for the airport. It combines information from third-party sources, such as live traffic and route data, published flight schedules, and reported airport security wait times, with the preferences you enter, and presents one suggested time.
2. Estimates, not guarantees
Every time LeaveBye shows you is an estimate. Traffic, weather, road closures, security lines, gate changes, and flight times change without notice, and the data we rely on can be delayed, incomplete, or wrong. LeaveBye does not know your exact circumstances and cannot promise that you will reach your gate on time.
You are responsible for your travel decisions. You decide when to leave, how much extra time to allow, and whether to follow any suggestion the Service makes. Always confirm your airline's and airport's recommended arrival time, check your flight status directly with your airline, and leave earlier whenever you are unsure. LeaveBye is a planning aid, not a substitute for your own judgment or your airline's instructions.
3. No warranty
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, timeliness, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any estimate will be correct.
4. Limitation of liability
To the fullest extent permitted by law, LeaveBye and its owners, members, employees, contractors, and data providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of time, missed or rebooked flights, missed connections, lost profits, or other costs arising out of or related to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability to you for any claim relating to the Service will not exceed ten U.S. dollars (US $10). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
5. Third-party services and data
The Service relies on third parties for maps, routes, addresses, flight information, and airport wait times, and links out to third-party apps such as ride-hailing and parking services. We do not control those services and are not responsible for their content, availability, pricing, or accuracy. Your use of them is governed by their own terms and policies.
Map, route, and address features are provided by Google Maps Platform. By using the Service you also agree to be bound by the Google Terms of Service and acknowledge the Google Privacy Policy.
6. Acceptable use
You may use the Service for personal, non-commercial travel planning. You agree not to access the Service with automated tools, scrape or bulk-collect its data, interfere with its operation, or attempt to circumvent its rate limits or security measures.
7. Your data
LeaveBye has no accounts and stores your trips, addresses, and preferences on your own device. How we handle the little that leaves your device is explained in our Privacy Policy, which is part of these Terms.
8. Changes and termination
We may update the Service or these Terms at any time. When the Terms change in a meaningful way, the app will ask you to acknowledge them again. Continuing to use the Service after a change means you accept the updated Terms. We may suspend or end the Service, or your access to it, at any time.
9. Governing law
These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Service will be brought in the state or federal courts located in Illinois, and you consent to their jurisdiction.
